1. Acceptance of Terms
By creating an account, downloading, or using the Peek mobile application ("Peek", "the Service", "we", "us", "our"), you ("you", "the User") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
You must be at least 13 years old to use Peek. If you are located in the European Economic Area (EEA), you must be at least 16 years old. By using the Service, you represent and warrant that you meet these age requirements.
If you are between 13 and 18 years old (or the age of legal majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
2. Description of Service
Peek is a mobile flashcard application available on Android. The Service allows you to:
- Create and manage personal flashcard decks and cards
- Study flashcards using spaced repetition algorithms
- Share your decks publicly for other users to discover and follow
- Follow and study public decks created by other users
- Use pre-built decks provided by Peek
- Receive push notifications (e.g., study reminders) — you can disable these in your device settings
Peek is operated by Ilia Kuzmin, an individual based in the Netherlands.
3. Accounts
3.1 Account Creation
To use certain features of the Service, you must create an account by providing a valid email address and password. You may also use the Service with limited functionality without creating an account (anonymous/device-based access).
3.2 Account Responsibilities
You agree to:
- Provide accurate and complete information when creating your account
- Maintain the security and confidentiality of your password
- Not share your account credentials with others
- Notify us immediately at support@peek.cards if you suspect unauthorized access to your account
You are responsible for all activity that occurs under your account.
3.3 One Account per Person
Each individual may maintain only one account. We reserve the right to remove duplicate accounts.
4. User Content and Intellectual Property
4.1 Your Content
You retain ownership of all content you create within Peek, including flashcard decks, cards, and any text or media you add ("User Content").
By making your content publicly available, you grant Peek a worldwide, non-exclusive, royalty-free, transferable license to use, display, reproduce, and distribute your User Content solely for the purpose of operating and providing the Service. This license ends when you delete your content or your account, except where your content has been shared with or followed by other users.
4.2 Peek's Intellectual Property
Peek and its original content (excluding User Content), features, and functionality — including but not limited to the application design, logos, pre-built decks, and spaced repetition algorithms — are and remain the exclusive property of Ilia Kuzmin. You may not:
- Copy, modify, or create derivative works based on the Service
- Reverse engineer, decompile, or disassemble the application
- Remove any copyright, trademark, or other proprietary notices
- Use the Peek name, logo, or branding without prior written consent
5. Acceptable Use Policy
You agree not to use the Service to create, upload, share, or distribute content that:
- Contains hate speech, promotes violence, or harasses, threatens, or intimidates any person or group
- Infringes on the intellectual property rights of others, including copyrights and trademarks
- Contains sexually explicit or adult material
- Is spam, junk, or unsolicited promotional material
- Contains malware, viruses, or any harmful code
- Is fraudulent, deceptive, or misleading
- Violates any applicable local, national, or international law or regulation
- Contains personal information of others without their consent
5.1 Consequences of Violations
If you violate this Acceptable Use Policy, we may, at our sole discretion:
- Remove or modify the offending content
- Temporarily suspend your account
- Permanently ban your account
We will make reasonable efforts to notify you before or at the time of taking action, unless immediate action is required to protect other users or the Service.
5.2 Copyright Infringement and DMCA
If you believe that content on Peek infringes your copyright, please send a notice to support@peek.cards containing:
- A description of the copyrighted work you claim has been infringed
- A description of the material you claim is infringing, and its location within the Service
- Your contact information (name, email address, and phone number)
- A statement that you have a good faith belief that the use is not authorized by the copyright owner
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner
- Your physical or electronic signature
We will respond to valid copyright notices and may remove infringing content.
6. Public Decks and Moderation
6.1 Public Availability
When you make a deck public, it is submitted for review. Public decks require approval before becoming visible to other users. We review decks for compliance with these Terms and our Acceptable Use Policy.
6.2 Moderation Rights
We reserve the right to:
- Approve, reject, remove, or modify any public deck at our sole discretion
- Remove public decks that violate these Terms without prior notice
- Change the visibility of any deck for any reason
6.3 No Guarantee of Availability
We do not guarantee that public decks will remain available indefinitely. Decks may be removed by their creators, by moderation, or due to account deletion.
7. Subscriptions and Payments
Peek is currently available free of charge. If we introduce paid features or subscription plans in the future:
- Pricing, billing periods, and features will be clearly communicated before purchase
- Subscriptions purchased through the Google Play Store will be subject to the store's terms and conditions, including auto-renewal, cancellation, and refund policies
- You can manage or cancel your subscriptions through your device's Google Play Store settings
- We will provide at least 30 days' notice before any price changes take effect
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted, timely, secure, or error-free
- The results obtained from the Service will be accurate or reliable
- Any errors in the Service will be corrected
Your use of the Service is at your sole risk.
For EU users: Nothing in these Terms limits your rights under mandatory consumer protection laws of your country of residence within the European Union.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ILIA KUZMIN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
For EU users: This limitation of liability does not apply to damages caused by willful misconduct or gross negligence, or where otherwise prohibited by mandatory EU consumer protection laws.
10. Account Suspension and Termination
10.1 Termination by Peek
We may suspend or terminate your account at any time if:
- You violate these Terms or the Acceptable Use Policy
- Your account is used for fraudulent or illegal activity
- Continued provision of the Service to you is no longer commercially viable
Where possible, we will provide notice before suspending or terminating your account.
10.2 Termination by You
You may delete your account at any time through the application settings or by contacting us at support@peek.cards.
10.3 Effect of Termination
Upon account termination:
- Your access to the Service will cease
- Your personal data will be deleted in accordance with our Privacy Policy
- Public decks that have been followed by other users may remain available in anonymized form, or may be removed at our discretion
11. Privacy
Your use of the Service is also governed by our Privacy Policy, available at peek.cards/privacy. The Privacy Policy explains how we collect, use, and protect your personal data, including your rights under GDPR and CCPA.
12. Changes to These Terms
We may update these Terms from time to time. When we make material changes:
- We will notify you via in-app notification or email at least 30 days before the changes take effect
- The "Last Updated" date at the top of this page will be revised
Your continued use of the Service after the notice period constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and delete your account.
13. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.
Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of the Netherlands.
For EU consumers: If you are a consumer residing in the European Union, you also enjoy the protection of the mandatory provisions of consumer protection law in your country of residence. Nothing in these Terms affects your rights as a consumer to rely on those mandatory provisions.
14. Dispute Resolution
14.1 Informal Resolution
Before filing any legal claim, you agree to try to resolve the dispute informally by contacting us at support@peek.cards. We will attempt to resolve the dispute within 30 days of receiving your notice.
14.2 Formal Proceedings
If the dispute is not resolved informally within 30 days, either party may proceed to the courts of the Netherlands as set out in Section 13.
14.3 EU Online Dispute Resolution
If you are a consumer in the European Union, you may also submit a complaint through the EU Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.
15. General Provisions
15.1 Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.
15.2 Entire Agreement
These Terms, together with the Privacy Policy and the End User License Agreement (EULA), constitute the entire agreement between you and Peek regarding the use of the Service, and supersede all prior agreements and understandings.
15.3 Waiver
Our failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision.
15.4 Assignment
We may assign or transfer our rights and obligations under these Terms without restriction. You may not assign or transfer your rights without our prior written consent.
